Subway® MVP Rewards Terms

These Subway® MVP Rewards Terms (“Terms”), together with the terms governing your access to and use of our websites and mobile apps, as applicable, govern your participation in the Subway® MVP Rewards program. These Terms form a binding contract between you and Subway MyWay LLC, if you are located in the United States Territory (as defined below) or, if you are located in Canada, between you and Subway MyWay of Canada, ULC (as applicable, “Subway®,” “we,” “us,” or “our”). Our websites and mobile apps are, together, referred to as the “Site(s)”.

By clicking “SIGN UP” or by otherwise participating in Subway® MVP Rewards, you (agree that you have read and understand these Terms.

These Terms include and are subject to the terms governing your access to and use of the applicable Site(s) (the “Site Terms”), for example and as applicable, our Terms of Use.

While we operate the Sites and administer the Subway® MVP Rewards program, neither we nor any of our affiliates is responsible for the operation of Subway® restaurants. Instead, Subway® restaurants are owned and operated by independent franchisees. Each restaurant is solely and independently responsible for any issues relating to the sale of products to you.

Except where prohibited by applicable law, we reserve the right to modify these Terms at any time. All changes will be effective immediately upon posting to the Site and, by accessing or using the Site after changes are posted, you agree to those changes. Material changes will be prominently posted on the Site.

1. Geographic Scope & General Requirements

The Subway® MVP Rewards program (“Subway® MVP Rewards” or the “Program”) is operated by us on behalf of participating Subway® restaurants in the United States, District of Columbia, Puerto Rico, Guam, Northern Mariana Islands, and on certain international U.S. military installations, which includes certain Army & Air Forces Exchange Service (“AAFES”) and Navy Exchange Service Command (“NEXCOM”) locations (AAFES and NEXCOM locations, together, “international U.S. military locations”); (together, the “United States Territory”), and in Canada.

We reserve the right to change, modify and/or eliminate Subway® MVP Rewards, and/or all or any portion of FAQ, or guideline pertaining to Subway® MVP Rewards at any time and at our sole discretion. Any changes or modifications will be effective immediately upon posting the changes which may be accessed through the Site. Your continued participation in or access to Subway® MVP Rewards confirms your acceptance of these Terms and any changes or modifications to these Terms. You should review these Terms and our policies and FAQs frequently to understand the terms and conditions that apply to your enrollment and participation in Subway® MVP Rewards.

Subway® MVP Rewards is intended for individual use only. Commercial use is prohibited. To participate you must be a legal resident of either the United States Territory or of Canada. Subway® MVP Rewards is not targeted toward, nor intended for use by, anyone under the age of 18. If you register for Subway® MVP Rewards you must be 18 years of age or older to participate. Enrollment and participation in Subway® MVP Rewards is complimentary.

2. Subway® MVP Rewards Account

Your Subway® MVP Rewards account is personal to you, and you can only have one Subway® MVP Rewards account. Your Subway® MVP Rewards account and any associated Points, Subway® Cash, and other Rewards cannot be sold, transferred, assigned to, or shared with, family, friends, or others.

If we discover that you have more than one account, we reserve the right to terminate any and all of your accounts, and you shall immediately forfeit all Points, Subway® Cash, and Rewards upon such termination. You are responsible for ensuring that no unauthorized person has access to your Subway® MVP Rewards account or your Subway® Card (“Card”). You are responsible for all activity on your Subway® MVP Rewards account.

Without notice to you and in our sole discretion, we reserve the right to suspend or terminate your Subway® MVP Rewards account or access to your account if we determine that you have violated these Terms or the Site Terms, that there has been fraudulent, deceptive, or unlawful activity on your account, or for the performance of routine or non-routine maintenance, error correction or for any other purpose. If we terminate your Subway® MVP Rewards account, you shall immediately forfeit all associated Points, Subway® Cash, and Rewards.

3. Availability

Subway® MVP Rewards availability is subject to Subway® restaurant participation. Some Subway® restaurants may not participate in Subway® MVP Rewards. Ask prior to placing your order or call ahead to the applicable Subway® restaurant to confirm if you can earn Points or redeem Subway® Cash and other Rewards at that specific Subway® restaurant. Some features of Subway® MVP Rewards, such as the ability to scan your account information via the via the Subway® App, may not be available in certain countries or locations.

4. How to Enroll & Communications

To begin earning Points and other Rewards when ordering any of the food items or other products at a participating Subway® restaurant that are eligible (“Eligible Items”), you can enroll in the Program through the Site(s) (including, as applicable, through the Subway® App). You will not be able to enroll through any other means and you will need to agree to these Terms to enroll and participate in Subway® MVP Rewards. Please note that Eligible Items may change depending on availability and at the discretion of the specific participating Subway® restaurant and that we have no control over the availability of any Eligible Items.

As a condition of membership in Subway® MVP Rewards, you will be asked to provide a valid email when you enroll, which we, our affiliates, and our and their respective designees and service providers will use to contact you about your account, Points balance, available Subway® Cash and Rewards, and as otherwise permitted by applicable law. We may also send you such communications via the Subway® App if you choose to receive push notifications. You can opt out of receiving any such push notifications by changing your device settings. You may also receive a push notification or email during the checkout process in a Subway® restaurant.

5. Linking Your Card: Digital and Plastic

Once you have successfully enrolled in Subway® MVP Rewards you will be assigned a Program account (“Member Account”) that is accessible via the Sites upon login. You may choose to link your Member Account to your Card, which can be obtained from any participating Subway® restaurant, subject to availability. Once your Member Account is linked to your Card, the Card can then be used as identification when earning and redeeming Points and Rewards at participating Subway® restaurants. If you use an unregistered Card at a participating Subway® restaurant, you can earn Points on the associated transaction provided you register the Card and connect it to your Member Account via the Sites or link the Card to your Member Account within 48 hours.

6. Earning Points and Rewards; Membership Levels

As a Subway® MVP Rewards member, you can earn Points on all Eligible Items that you purchase at participating Subway® restaurants, both in-restaurant and through placing an order through the Sites (“Online Ordering”). Online Orders are subject to additional Order Terms. To earn Points in restaurant, you must identify yourself at the participating Subway® restaurant as a Subway® MVP Rewards member by either providing the phone number associated with your Member Account, scanning your Member Account information via the QR code available in the Subway® App, or swiping your Card (if already registered and connected to your Member Account) before completing a purchase. Subway® MVP Rewards has three membership levels – Pro, Captain, and All-Star. Membership status is based on how much you spend annually. Members start out at Pro status. Members who spend two-hundred dollars ($200) annually will obtain Captain status. Members who spend four-hundred dollars ($400) annually will obtain All-Star status. A member must meet the qualifying spend threshold for a particular tier level each year in order to maintain their membership status the following year.

For members at the Pro membership level: For every one dollar ($1) you spend at a participating Subway® restaurant in the Territory on Eligible Items, you will be awarded ten (10) Points.

For members at the Captain membership level: For every one dollar ($1) you spend at a participating Subway® restaurant in the Territory on Eligible Items, you will be awarded eleven (11) Points.

For members at the All-Star membership level: For every one dollar ($1) you spend at a participating Subway® restaurant in the Territory on Eligible Items, you will be awarded twelve (12) Points.

In some instances, you may earn Points through a promotion or campaign that we sponsor (“Eligible Campaigns”). Your eligibility to earn Points through an Eligible Campaign (if applicable and only as available) is dependent on your acceptance and compliance with the applicable Eligible Campaign’s terms and conditions. Except for Points earned through Eligible Campaigns, Points are automatically added to your account within twenty-four (24) hours. Points are awarded based on your total purchase (less the exclusions listed below) and are rounded up or down to the nearest dollar, prior to sales and discounts.

Some exclusions apply. You cannot earn Points on purchases of alcoholic beverages or of gift cards (including gift card purchases, activations, reloads, transfers, or any other card-to-card transaction). Taxes, tips, donations, fees, (including, for example, delivery fees), bottle and can deposits, and bag fees (or bag taxes, as applicable) are also excluded and ineligible for Points awards. Online Orders placed through third party ordering services are not eligible for Points awards. We reserve the right to place limits on the number of Points you can earn on a daily and/or monthly basis.

Bonus Points may be awarded based on your purchase of or participation in a promotional offer. Bonus Points will be awarded as described in a promotional offer and may be subject to additional terms that are stated in the applicable promotional offer.

Once your balance reaches four hundred (400) Points, you can choose to convert the Points into $2 Subway® Cash (in either USD or CAD, as applicable, depending on where your Member Account was established), which is a discount coupon that can be used for two dollars ($2.00) off a future purchase at a participating Subway® restaurant (“Subway® Cash”). Points can also be accumulated and converted into larger amounts of Subway® Cash later. For example, 1200 Points can be accumulated and converted into $6 Subway® Cash. Subway® Cash is unique, associated solely with your Member Account, and for your use only.

IMPORTANT NOTE: Subway® Cash is not a gift certificate. All Points, Subway® Cash, and all other Rewards are promotional, have no cash value, and cannot be exchanged for cash or converted to a gift card balance. Except for redeeming Points for Subway® Cash in accordance with these Terms, Points have no value and may not be exchanged for cash or otherwise. You will lose any extra balance on a $2 Subway® Cash redemption that exceeds the bill amount. For example, if you use $4 Subway® Cash on a subtotal amount of $3.50, you will lose the remaining $0.50 from the second $2 applied in Subway® Cash. All Points, Subway® Cash, and other Rewards will expire on termination of your enrollment in Subway® MVP Rewards (whether terminated by you or by us) or termination of the Subway® MVP Rewards altogether, subject only to notice that is required by applicable law, if any.

7. How to Redeem Subway® Cash and other Rewards

To redeem Subway® Cash or other Rewards at a participating Subway® restaurant, you must identify yourself as a Subway® MVP Rewards member by either providing the phone number associated with your Member Account, scanning your Member Account information via the Subway® App, or swiping a registered Card before completing your purchase.

You can choose whether you want to apply the Subway® Cash or other Reward (if available) to your current purchase or not. Even if you choose not to redeem Subway® Cash or other Reward, identify yourself as a Subway® MVP Rewards member so you can earn more Points and so that the participating Subway® restaurant can check to see if there are any other promotional offers you might be eligible for (subject to availability) instead of, or in addition to, your Subway® Cash or other Reward.

To redeem your Subway® Cash or other Reward using Online Ordering through the Sites, you will be able to apply your Subway® Cash or other Reward prior to submitting your order. You may apply up to $50 in Subway® Cash to cover your subtotal balance (after discount is applied but before sales tax). Rewards cannot be used for catering orders placed through a third-party services (e.g. EZ Cater).

If Subway® Cash or other Reward has been redeemed, it will no longer be valid for future purchases.

Once you have converted Points into Subway® Cash or are notified that you have received a Reward, you are eligible to use your Subway® Cash or Reward for any future qualifying purchase (prior to its expiration, as specified in these Terms) at a participating Subway® restaurant in the Territory.

A notification may be sent to your email or noted within your Member Account through the Sites to inform you when you have been awarded a Reward that you can use on a future qualifying purchase.

In addition to earning Points, you may also be eligible to receive other Rewards on occasion (if applicable and subject to availability). These are not Points-based offers and may be subject to additional terms and conditions that must be accepted or met in order to redeem the applicable promotional offer which will be stated in the Reward.

8. Void Points and Rewards

Any Points or Rewards you were awarded from a transaction that is later voided for any reason, shall be deducted from your Subway® MVP Rewards account balance.

9. Suspension & Cancellation

Without notice to you, all earning, and redemption activities shall be suspended on Subway® MVP Rewards accounts that have been “frozen” due to actual or suspected fraudulent activity, as determined by us in our sole discretion.

To cancel your membership at any time, please contact Guest Care using the link below. Your membership in Subway® MVP Rewards will be terminated within thirty (30) days and, subject only to any notice that may be required by law, all Points, Subway® Cash, and all other Rewards will expire and become void upon the date of termination.

10. Missing Points

If you forget to identify yourself as a Subway® MVP Rewards member prior to checkout in restaurant you can utilize our missing Points process, as detailed in these Terms below.

You may be able submit a “Missing Points” request form via the Sites for a purchase that has occurred within the preceding thirty (30) days. While filling out this form, you will be prompted to provide details from your purchase receipt. If you cannot provide the relevant details from your purchase receipt as necessary, you cannot submit a Missing Points request.

After you have submitted this form, check your Member Account on the Sites 48 hours after you submitted the form to learn if your request has been granted. We reserve the right to limit the amount of missing Points requests that you may submit.

11. Expiration of Points Subway® Cash and other Rewards; Termination of Account

Points earned through Subway® MVP Rewards Member Account transactions expire after six (6) months if there has been no activity on the Member Account in that six (6) month period. As used herein, “activity” is defined as any positive change to your Member Account balance, the earning of any Points, or any Subway® Cash or other Reward redemption. If your account shows any activity within that period of six (6) months, the expiration date of all your Points will be reset.

Other Rewards, obtained through promotional offers, may be subject to additional terms and conditions, including a shorter expiration date, which will be stated in the applicable promotional offer.

If you don’t redeem your Reward by the pre-identified expiration date, the Reward will expire; it will no longer be valid; and it will be deducted from your account.

Without notice to you, we reserve the right to terminate or suspend your account in the event that your account is inactive for more than twelve (12) months.

12. Combining Reward Offers

Multiple Rewards cannot be combined and used on the same item.

Subway® Cash may be combined with other Rewards or offers (as applicable and subject to availability).

13. NO WARRANTIES; LIMITATION OF LIABILITY

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW AND WITHOUT LIMITING THE GENERALITY OF THE DISCLAIMERS OF WARRANTIES OR CONDITIONS IN THE SITE TERMS, THE SITES AND SUBWAY® MVP REWARDS ARE PROVIDED ON AN "AS IS" AND “AS AVAILABLE” BASIS WITHOUT ANY CONDITIONS, REPRESENTATIONS, OR WARRANTIES OF ANY KIND WHATSOEVER, WHETHER EXPRESSED, IMPLIED, STATUTORY, OR OTHERWISE.

EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW AND WITHOUT LIMITING THE GENERALITY OF THE EXCLUSIONS AND LIMITATIONS OF LIABILITY IN THE SITE TERMS, IN NO EVENT WILL WE OR ANY OF OUR AFFILIATES HAVE ANY LIABILITY OR RESPONSIBILITY FOR ANY AMOUNT OR KIND OF LOSS OR DAMAGE THAT MAY RESULT TO OR BE INCURRED BY YOU OR A THIRD PARTY, ARISING OUT OF OR IN CONNECTION WITH YOUR ENROLLMENT IN OR USE OF THE SITES OR SUBWAY® MVP REWARDS.

14. Indemnification

You agree to indemnify, defend and hold harmless us and our affiliates from and against any and all claims (including but not limited to third-party claims), demands, complaints, actions, damages, losses, judgments, settlements, fines, costs, expenses, and liabilities (including reasonable legal fees) arising out of or in connection with your enrollment in or use of the Sites or Subway® MVP Rewards. We reserve, and you grant to us, the exclusive right to assume the defense and control of any matter subject to indemnification by you.

15. Privacy

Your personal information will be treated in accordance with our Privacy Statement. We may send you order confirmations or other transactional text messages with your consent. Text STOP to opt out. Text HELP for help. Standard message and data rates may apply.

16. General

You have no ownership interest in Points, Subway® Cash, or any other Rewards. Use of the word "earn" in marketing materials in relation to Subway® MVP Rewards shall mean "collect" and shall not infer that the Points, Subway® Cash, or any other Rewards have any value until they are redeemed. Points may not be purchased or sold and are not transferable except as otherwise stated herein. Despite our efforts to ensure accuracy, errors occasionally occur. We reserve the right to correct such errors at any time even if it affects pending Points, Subway® Cash, or other Rewards or balance in your account.

In the event of any inconsistency or discrepancy between these Terms and other statements contained in any related materials or advertising, these Terms shall prevail, govern, and control.

These Terms, including the Site Terms, constitute the entire understanding between you and us with respect to the subject matter of these Terms. These Terms, the enrollment in or use of the Subway® MVP Rewards, and any claims, controversies, or disputes related to or arising therefrom are governed by the body of law in, and will be resolved in accordance with the dispute resolution provisions of, the Site Terms.

We will not be liable to you or to any third party for any delay or other failure to perform under these Terms that is due to causes beyond our control or the control of third-party fulfillment providers, including without limitation acts of God, terrorism, civil disorders, labor disputes, shortages, riot, war, strikes, acts of a public enemy, acts of any government, country, territory, political division thereof, or government agency, fires, floods, earthquakes, blizzards, other extraordinary elements of nature, epidemics, pandemics, acts or omissions of third parties, telecommunications failures, Internet failures, and similar causes and events.

Note that we are only responsible for customer service issues relating to your Subway® MVP Rewards account. Problems with the use of Subway® MVP Rewards at a Subway® restaurant are the responsibility of that restaurant.
